IMAGE THEFT by a popular store, wanna help?

I was informed over the weekend that one of my photographs (an image uploaded to flickr, deviantART and lookbook) was recently stolen by a big clothing company and is now being sold on shirts in Europe.

This is the shirt

The company in question is RESERVED. You can click the link and go to their website. They have many shirts listed there but mysteriously enough, the shirt that has the ripped photograph on it is not listed. Perhaps on purpose? Quite possible.

If you live in Europe or anywhere that there is a reserved store near you (you can find a store locator on the site) I would love it if you could go in and see if they are selling the shirt. I cannot find out for myself since I am located in the United States. If you spot this shirt, I'd love if you could take a camera phone/other picture and email it to me at the email address listed on the sidebar! If you can, I'd love to know the shops location and how much they are selling it for, too.

I do not intend on suing them yet as I hope they will resolve this by giving me credit and compensation before we have to take it there, but the company that owns the store has not yet responded to my email inquiring about the image theft. I will be sure to keep you updated on what happens!

Everyone should be on the lookout as your own image posted to the blogosphere/lookbook/ANYWHERE can easily be victim of this type of theft. I'm guessing they hired a designer who didn't think I'd ever see the image being in the United States and all... but who really knows. I'm just hoping this can all be settled in a civil manner!

xoxo,
Rockie

I had the same thing happen to me earlier this year with a major australian clothing company and despite writing them a letter of demand to remove the shirt and even speaking to a lawyer, absolutely nothing got done and they basically got away with it (they even told a major radio station they had no knowledge of my contact with them when I was interviewed about it).

I hope you get better luck than me and I'm so sorry that this has happened to you also :(

That's just crazy. That brand's pretty big and so weird to see something like that happen :S
There are no their shops in my city but I'll ask my foreign friends to have a look!
I hope whoever stole it won't get away with it!

Wow, i can't believe they've done that, they're such a big brand you'd think they'd have their own photographers for that type of thing. I hope it gets sorted out!

That's shocking! There isn't a shop in Germany so I can't help to find out if they are selling the shirts but I posted about this case. Maybe some other European blogger will read my post. Btw I really like your photographs!

This is really shocking. First I thought Betty's photo was the only one 'stolen' by a big company.
I think it honours you a bit but the edit of the photo on the shirt is horrible and it's really unfair to print photos of someone without asking and paying them.

Here in Germany is no 'reserved' store but I'll blog about it anyways. Maybe one of my international readers have a 'reserved' store in their country. ;)

Hi Rockie! Reserved is polish shop and I'm from Poland, so I checked their shop near me and I'm very disappointed because they are still selling this t-shirt! It's horrible! Such a shame :(

wow this is shit... be sure you get just compensation, and if you have to sue then sue! Don't let this company get away with this, or others will follow suit. You are in a powerful role, for fellow photographers as well. Go with it!

I'm from Poland and I was really surprise, when I saw this photo here. (Reserved is from Poland, actually) I've seen this t'shirt before in shop in my city and I can't believe they did it! I can go there tomorrow, check other tees and send you photos :)

I found another person who stole a photo from you on Hyves.
I already reported her but we need more people to report so it will be taken of right away.
You can do this by going to this page:

http://mode-fotografie.hyves.nl/album/505653/Fashion_Modellen_en_Fotografie/htBYL8kD/fotos/986030692/0/fGp_/?&pageid=8DCMRJ6XLS004CK4K

Under the picture you can see four buttons. You need to click the ''Dit is niet OK'' button. Then choose ''nepprofiel'' or ''overig'' And in ''Toelichting'' you can write that the real picture is made by Rockie (be sure to provide a link to one of her sites).
I'm not sure if you need a profile to do this, but if you happen to have a profile then please report.

It makes me sad to see that people steal your photos. It happened to me as well and that is why I don't upload anything these days. I really hope the shirt issue will be solved (just like the case I stated above)
Good luck Rockie!

I can help you in Poland. You should find a good Polish lawer and set up the litigation. Oh even, one of the famous polish newspaper wrote about your photo stolen by Reserved. Article can be find here: http://wyborcza.biz/biznes/1,100896,8016144,Amerykanka_oskarza_Reserved_o_kradziez_zdjecia.html

Hey! I do not know of any shop with that name in Portugal, but if I do i'll surely let you know, don't worry! If you know any good intellectual property lawyer you should definitely make a move. I had intellectual property classes with a great American lawyer/professor (Raymond T. Nimmer, Uni of Houston), and i know they can nail these people down!

Hi Rockie!
Good news! I haven't seen your T- shirt in the reserved shop, although I've looked for it quite properly. There are a lot of other white T-shirts with photos, but none of them was yours. I think they might have stolen a lot of other's people work, just like yours.
I hope helped.

p.s. I live in Budapest, Hungary
